The Red Flag law is nothing new. It is an old tactic used by corrupt governments to confiscate firearms from innocent citizens and secure absolute, tyrannical power. It creates a snitch society, pitting citizen against citizen on behalf of the state. In 2019, Colorado’s Democrat legislature and governor crafted this barbaric idea into law with a fancy new name, the “Extreme Risk Protection Order,” conveniently veiling it as a mental health bill.
We’ve talked a lot about the Red Flag law on this site, specifically how it violates the First, Second, and Fourth Amendments as well as foundational Constitutional due process in court (see the end of this post for details). As if all those violations aren’t egregious enough, Bazzel Baz shares more staggering insight about this dangerous law.
From the mind of a former CIA Officer and Marine Counter-Terrorism Officer who has firsthand experience with corrupt governments worldwide enforcing their own versions of our Red Flag law, Baz shared this on the show (full audio interview below):
Based on my experiences, I am of the opinion that Governor Polis has engineered a threat to personal property with the Red Flag Law. He and those who support him are conspiring to “police” the public of personal property. It isn’t just about guns and it won’t be just about guns in the future if this law is allowed to exist. … The Red Flag Law has another ugly side to it, the potential to confiscate land, homes, businesses or whatever the state government decides … It will destroy our economy, it will destroy our neighbors and neighborhoods, it will destroy our institutions of learning and create more turmoil than any politician is prepared or qualified to handle. … With the Red Flag Law Polis is legalizing hearsay to get a search warrant. He is breaking the law and … telling the Colorado people, ”If you care to talk to us we will organize a search party and violate someone’s 2nd and 4th Amendment rights and take away his or her ability to defend their home. … And that is just for starters.”

In previous shows, we’ve shared how the Red Flag Law violates these specific Constitutional safeguards:
First Amendment: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
- Now when you speak in Colorado, the Red Flag law ensures that your speech may be used against you as “evidence” of a “threat” so that an Extreme Risk Protection Order can be issued to either confiscate your firearms and/or prevent you from ever acquiring firearms.
Second Amendment: A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.
- The Red Flag law blatantly authorizes law enforcement to infringe upon your Second Amendment rights and confiscate your firearms.
Fourth Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
- The Red Flag law authorizes that your home can now be searched and firearms seized, without probable cause that any crime has been committed.
Due Process – Fifth Amendment: No person shall be … deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
Due Process – Fourteenth Amendment: No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
- Forget about “innocent until proven guilty” here in Colorado. If a Red Flag Extreme Risk Protection Order is issued, you will never know about it until law enforcement arrives at your door, using force to enter and confiscate, if necessary. You will be presumed guilty until you can miraculously prove yourself innocent from the hearsay, and your accuser will never have to face you in court.
