Noah Webster, Net Effect, and the Bureaucracies of Healthcare

Still not convinced government run health care is unconstitutional?  Let’s go back to the words of one of our founders, Noah Webster.  His 1828 American Dictionary of the English Language defines the term Unconstititutional as:  “Not agreeable to the constitution;  not authorized by the constitution;  contrary to the principles of the constitution.” 

Based on Mr. Webster’s definition, is government healthcare legislation agreeable with the Constitution?  Is it authorized by the Constitution?  Is it contrary to the Constitution? 

Let’s ponder just a handful of  the undeniable results of government healthcare, things like:   jailtime for refusing to purchase insurance… de-privatization of the healthcare market which squashes advancements like medical research, development, and innovation… death lists (ie, “wait lists for vital care”)… degradation of overall quality of healthcare provided in the US… healthcare rationing…. I could go on… but perhaps you get the idea. 

If you’re not convinced that healthcare legislation itself is unconstitutional (see my blog entry “Government Health Care and the Constitution”), then at least weigh the end results of healthcare legislation against basic Constitutional principles…  The way I see it, the end results (of which I’ve listed only a handful out of potentially thousands more) which would adversely affect every citizen of the United States, are neither “ agreeable to” nor  “authorized by” the Constitution…  and they are absolutely contrary to the principles of the Constitution.

Now consider this single point:  government bureaucracies have become a form of administrative law in the United States… when Congress identifies a problem, legislators pass laws… those laws create unelected and unaccountable agencies that draft “regulations”… those regulations then have the effect of law to solve the purported problems.  The net effect is this:  Constitutional law is degraded and irrelevant, superseded by bureaucratic administrative law. 

When legislation is enacted that serves to erode and eventually destroy the legitimacy of the Constitution… is not that very legislation… by default… its “net effect”… unconstitutional, as Noah Webster defined it?  

With that in mind, here are the 111 new bureaucracies created by Nancy Pelosi’s “Affordable Healthcare for America Act” HR 3962.  111 brand new arms of the law to regulate our lives and completely  undermine our Constitutional law of the land.  Don’t give up the fight to KILL the BILL:

    I like the angle you brought to light addressing the definition of the Unconstitutional. As well thank you for the extensive list exemplifying the expansion of Federal power. It further illustrates dependency issues.

    We have been massaged to assume the position as Children to the State. Lacking the maturity, knowledge, and personal responsibility to move into the dangerous world of adulthood. For as adults we understand that we must make decisions, and with those decisions there is always consequence. That consequence could be positive or negative, but we must live with the consequence and make the decisions regardless. Yet so many seem quick to not apply that with Government; perhaps because it is easier to be Children than to be adults.

    What is it going to take to understand that rights can only be waived by permission which is clear in the Constitution. Yes, this can unfortunately be done unknowingly by default. When we accept benefits and privileges we agree to be compelled to performance of existing legislation and all future and actively consent waiving relevant rights. Thus we are resulted with Civil Liberties which is quite different than unalienable rights.

    When we see Federal Grants we should be weary as well as that provides extra vehicles to compel states to perform and enact legislature that reflects the Federal demands.
